Direct answer
Asset tracing and asset recovery are different legal stages
Begin with the alleged source property and follow each transfer, currency conversion, entity, nominee, trust, wallet or asset acquisition. Record legal and beneficial ownership, jurisdiction, date, value and supporting source. Intelligence or a leaked document may justify inquiry, but court use and restraint require the evidentiary and cooperation route applicable to the jurisdiction.
Separately map letters rogatory, mutual legal assistance, PMLA reciprocal arrangements, Interpol or CBI coordination, foreign civil disclosure and domestic production. Authentication, chain, translation, bank secrecy, data protection and privilege may affect use. Avoid counting the same value in an Indian outgoing transfer, foreign account balance and purchased asset as three separate proceeds amounts.
Legal analysis
Cross-border work separates trace, proof, restraint and recovery
Each stage uses different authorities and standards. The case map should show which stage every document supports.
Value trace
Follow money or property across accounts, currencies, entities and assets. Note fees, market movement, repayments, legitimate co-mingled funds and internal transfers.
Practical focus: Maintain original-currency and converted-value columns with valuation date and rate source.
Ownership and control
Foreign registries may show legal title but not beneficial control; trusts and nominees require instrument, settlor, trustee, protector and beneficiary analysis.
Practical focus: Use a jurisdiction-specific ownership chart with source reliability noted.
Evidence route
Voluntary records, subpoenaed material, mutual-assistance production and intelligence have different provenance. Certification and translation can determine court use.
Practical focus: Tag each document as lead, verified record or proposed evidence.
Restraint and third parties
Foreign and Indian restraint orders may have different scope and recognition processes. Secured creditors, spouses, investors and business operations require local-law evidence.
Practical focus: Coordinate local counsel and avoid promising Indian relief will automatically bind a foreign asset.
Evidence plan
International records need a provenance ledger
Every foreign document should show source, legal acquisition, custodian, language, certification, date and purpose.
| Record | What it may establish | What it cannot establish by itself |
|---|---|---|
| SWIFT, remittance and correspondent-bank data | Cross-border movement and routing | Beneficial owner or unlawful source alone |
| Foreign company and trust records | Legal structure, office-holders and declared interests | Actual control without underlying instruments and conduct |
| Foreign bank and custody statements | Accounts, assets, trades and balances | Indian-law character or complete source |
| Property and asset registries | Title, acquisition and encumbrance in the jurisdiction | Source of purchase money |
| MLAT or letters-rogatory record | Official evidence-request route and scope | Truth of produced content without evaluation |
| Translations and certifications | Authenticity and intelligibility | Substantive reliability by themselves |
Response roadmap
A cross-border asset file from lead to enforceable record
- 01
Define the original alleged property
Fix source event, amount, owner and date before tracing transformations abroad.
- 02
Build jurisdiction-by-jurisdiction maps
List entities, accounts, assets, controllers, local lawyers and available registries.
- 03
Classify every source
Separate open-source or intelligence leads from authenticated records and court-usable evidence.
- 04
Coordinate cooperation and restraint
Identify Indian central authorities, foreign channels, urgency and local recognition or freezing requirements.
- 05
Protect valuation and third-party accuracy
Prevent double counting, document conversion rates and separately assess lawful co-owners, lenders and investors.
Delhi forum context
New Delhi institutions may coordinate, but foreign law still matters
ED headquarters, CBI/IPCU, MEA, the Adjudicating Authority, Appellate Tribunal, High Court and Supreme Court are relevant to different Indian stages. The requesting or receiving foreign state applies its own law to evidence production, restraint and enforcement.
A Delhi filing should identify the Indian power and relief. It should not ask the High Court to issue an order assumed to operate automatically against a foreign bank or registry without the applicable cooperation and recognition framework.
Focused questions
Questions commonly arising at this stage
Can the ED attach property outside India?
PMLA contains provisions addressing property abroad and value, and international cooperation mechanisms may be used. The exact property, reciprocal framework, foreign law and orders must be examined.
What is an MLAT request?
Mutual legal assistance provides a state-to-state framework for specified criminal evidence or assistance. The treaty, central authorities, request content and executing state's law control the process.
Can foreign bank records be filed directly in an Indian court?
Their admissibility, certification, proof and method of acquisition require analysis. A downloaded statement or email copy may be useful but is not automatically equivalent to officially obtained evidence.
How should cryptocurrency be valued across transfers?
Record token, quantity, wallet, transaction hash, time, exchange and valuation source at each legally relevant point. Market movement should not be confused with additional criminal proceeds.

Case preparation
Convert the papers into a dated, transaction-level brief
For an initial assessment, organise the latest summons or order, case particulars, a one-page chronology, the relevant bank or property trail, and the exact next deadline. Do not alter, rename or selectively delete electronic records.
