FEMA regulations and RBI directions can change, so the rule applicable on the transaction date should be retrieved rather than inferred from current banking practice.
A summons or show-cause response should reconcile bank, tax, company and foreign records. Determine whether the allegation concerns prohibited dealing, holding, payment, borrowing, investment, export proceeds, reporting or another obligation. Compounding, adjudication and appeal are different choices. PMLA should not be assumed merely because ED administers both statutes; a scheduled offence and proceeds analysis remains separate.

Resident status and person

Determine whether approval, authorised dealer processing, pricing, sectoral conditions, forms or time-bound reporting applied and what was actually done.

Remedy and overlap
Investigation, show-cause, adjudication, penalty, compounding and appeal have different records and consequences. Tax and PMLA overlap should be separately identified.
Practical focus: Prepare a remedy comparison before making admissions in a compounding or adjudication record.

The Appellate Tribunal located in New Delhi currently handles appeals across several asset and foreign-exchange statutes. Current jurisdiction, filing category and procedure should be checked on the official Tribunal and Department of Revenue portals.
A Delhi High Court remedy depends on the statutory route and jurisdictional facts. The fact that an authorised dealer has a Delhi head office does not necessarily make Delhi the forum for a transaction handled elsewhere.

Is a FEMA contravention a money-laundering offence?
Not automatically. FEMA and PMLA are separate statutes. PMLA requires its own scheduled-offence and proceeds-of-crime analysis.
Can a FEMA matter be compounded?
Many contraventions may have a compounding route subject to the statute, regulations, authority, facts and exclusions. The exact transaction and parallel proceedings should be reviewed before applying.
Does bank processing prove FEMA compliance?
It is important evidence, but the customer remains responsible for accurate purpose, documents and applicable conditions. Bank processing does not conclusively decide every legal requirement.
Where is a FEMA appeal filed?
The impugned order and governing provision determine the appellate forum, limitation and any deposit requirement. The official Tribunal and e-filing portals should be checked for current procedure.
