Foreign Exchange Management Act, 1999

FEMA Lawyer in Delhi: ED Investigation, Adjudication and Appeal

FEMA regulates foreign exchange through a primarily civil contravention framework, while particular conduct may also trigger tax, customs, company, black-money or PMLA questions. The response must identify the transaction date, resident status, regulation, permission route and movement of value.

Direct answer

FEMA analysis begins with transaction, status, route and reporting

Identify the person and residency status, date, amount, currency, sender, recipient, bank, purpose code, underlying contract or asset, permitted route, limit, approval and reporting. FEMA regulations and RBI directions can change, so the rule applicable on the transaction date should be retrieved rather than inferred from current banking practice.

A summons or show-cause response should reconcile bank, tax, company and foreign records. Determine whether the allegation concerns prohibited dealing, holding, payment, borrowing, investment, export proceeds, reporting or another obligation. Compounding, adjudication and appeal are different choices. PMLA should not be assumed merely because ED administers both statutes; a scheduled offence and proceeds analysis remains separate.

Scope: The correct remedy depends on the live papers, applicable notification, territorial link, procedural stage and the relief actually required.

Response roadmap

A FEMA response from transaction audit to remedy

  1. 01

Fix the transaction date and status

Record person, residence, amount, currency, parties, purpose and applicable regulation for that date.

  2. 02

    Collect the authorised-dealer file

Obtain forms, declarations, SWIFT or remittance records, purpose code, acknowledgements and correspondence.

  3. 03

    Reconcile commercial and regulatory documents

Match contract, invoice, share, loan, export or property records to funds and reporting.

  4. 04

    Assess adjudication or compounding

Compare legal basis, disclosure, timing, penalty exposure and parallel proceedings before selecting the route.

  5. 05

    Prepare appeal and deposit strategy

If an order is passed, calculate limitation, statutory forum, pre-deposit or waiver questions and interim relief from the actual order.

Delhi forum context

Delhi hosts central ED and appellate functions, but the transaction controls

The Appellate Tribunal located in New Delhi currently handles appeals across several asset and foreign-exchange statutes. Current jurisdiction, filing category and procedure should be checked on the official Tribunal and Department of Revenue portals.

A Delhi High Court remedy depends on the statutory route and jurisdictional facts. The fact that an authorised dealer has a Delhi head office does not necessarily make Delhi the forum for a transaction handled elsewhere.

Focused questions

Questions commonly arising at this stage

Is a FEMA contravention a money-laundering offence?

Not automatically. FEMA and PMLA are separate statutes. PMLA requires its own scheduled-offence and proceeds-of-crime analysis.

Can a FEMA matter be compounded?

Many contraventions may have a compounding route subject to the statute, regulations, authority, facts and exclusions. The exact transaction and parallel proceedings should be reviewed before applying.

Does bank processing prove FEMA compliance?

It is important evidence, but the customer remains responsible for accurate purpose, documents and applicable conditions. Bank processing does not conclusively decide every legal requirement.

Where is a FEMA appeal filed?

The impugned order and governing provision determine the appellate forum, limitation and any deposit requirement. The official Tribunal and e-filing portals should be checked for current procedure.

Case preparation

Convert the papers into a dated, transaction-level brief

For an initial assessment, organise the latest summons or order, case particulars, a one-page chronology, the relevant bank or property trail, and the exact next deadline. Do not alter, rename or selectively delete electronic records.
