Direct answer
Multiple agencies do not turn separate legal tests into one case
Begin with an agency-and-proceeding matrix. For each track, record the statute, case number, alleged period, persons named, documents seized or requested, statements, orders and next deadline. The same invoice or transfer may appear in several files, but the alleged offence and available remedy may differ.
A coordinated defence uses a master chronology and reconciled data room while preserving distinct pleadings. Statements to a bank, auditor, SFIO, police, CBI, tax authority or ED may later be compared. A hurried attempt to satisfy one agency with an incomplete explanation can create contradictions across the others. Internal privilege, employee interests, insurer or lender notifications and business-continuity decisions should also be assessed.
Legal analysis
The four maps required in a complex economic-offence brief
The case becomes manageable when agencies, entities, people and transactions are mapped separately and then cross-referenced.
Agency map
Identify the statutory source and subject of each investigation. EOW, CBI, SFIO, ED, tax and regulatory authorities do not have identical powers or purposes.
Practical focus: Maintain one status sheet per agency and a consolidated deadline calendar.
Entity map
Group structures, subsidiaries, vendors and related parties should be charted with actual ownership, management and transaction roles. Corporate proximity does not establish common criminal intent.
Practical focus: Use corporate filings, shareholder records and delegated-authority documents to verify the chart.
People map
Separate founders, directors, signatories, finance teams, sales personnel, consultants and beneficiaries. The legal and factual role may change over the alleged period.
Practical focus: Prepare period-specific responsibility notes; do not use current titles for historical conduct without proof.
Transaction map
Identify the specific disbursement, invoice, security, transfer or asset said to be fraudulent. Broad labels such as diversion or siphoning must be reconciled to actual entries and performance.
Practical focus: Create exception schedules rather than dumping the entire ledger on the investigator or court.
Evidence plan
Build a multi-agency evidence room with source and custody information
Documents should be searchable, dated and attributed to a custodian. The defence must know which version was supplied to which authority.
| Record | What it may establish | What it cannot establish by itself |
|---|---|---|
| Complaints, FIRs and agency orders | The scope and alleged offences of each track | That allegations across agencies are identical or proved |
| Company master data and board records | Entity structure, authority and formal decisions | Who actually negotiated or executed a disputed transaction |
| Loan, security and banking files | Sanction terms, utilisation conditions and account flows | Dishonest intention at inception without surrounding evidence |
| ERP, email and approval logs | Contemporaneous workflow, access and instructions | That every system user was the human decision-maker |
| Audit, tax and regulatory submissions | Prior disclosure and identified exceptions | That no offence occurred or that the filing was accurate |
| Seizure and production inventories | What each agency holds and the chain of supply | That the extracted material is complete or interpreted correctly |
Response roadmap
Coordinate the defence without creating a single generic reply
- 01
Inventory every proceeding
List agencies, case references, statutes, persons, assets, statements and next dates. Obtain copies instead of relying on summaries.
- 02
Preserve and lock the data room
Collect native files, record custodians and prevent routine deletion. Separate privileged advice and personal data from business evidence.
- 03
Reconcile the master facts
Create one chronology, entity chart and transaction schedule. Log genuine factual conflicts for investigation rather than concealing them.
- 04
Assess representation conflicts
Directors, employees, group companies and promoters may have different roles and risks. Joint counsel or joint interviews require careful conflict review.
- 05
Prepare forum-specific applications
Use the same verified facts but address the offence, burden, urgency and relief applicable to the particular agency or court.
Delhi forum context
Delhi economic-offence work may move across specialised institutions
Depending on notification and allocation, the matter may involve EOW, CBI, SFIO, ED, a Magistrate or Special Court, Rouse Avenue Courts, the High Court of Delhi, the Adjudicating Authority or the Appellate Tribunal. A corporate investigation located in Delhi may still involve evidence and proceedings in several states.
The forum note should identify why Delhi is legally relevant: the investigating office, registered office, transaction, court allocation, impugned order or statutory seat. Avoid creating duplicate city pages that merely replace place names; each forum page on this site addresses a distinct remedy and record.
Focused questions
Questions commonly arising at this stage
Can an EOW case and an ED case proceed from the same facts?
They may address different statutory allegations and can develop in parallel. The predicate criminal case and the PMLA investigation should be coordinated but not collapsed. Orders in one track may materially affect another and must be monitored.
Should the company and individual directors use one defence?
Not automatically. Interests may align initially but diverge on authority, instructions, benefit, disclosures or cooperation. A conflict review should occur before joint statements, common affidavits or sharing privileged strategy.
What is the first useful document in a banking-fraud investigation?
Often it is a reconciled facility-and-funds schedule: sanction, disbursement, conditions, utilisation, security, repayments, classification and the disputed transactions. The precise starting record depends on the allegation.
Can a business continue operating after accounts are restricted?
Business-continuity relief may be considered through the lawful forum with payroll, tax, essential-vendor and segregated-funds evidence. Moving operations through undisclosed accounts to defeat a restriction can worsen the case.

Case preparation
Convert the papers into a dated, transaction-level brief
For an initial assessment, organise the latest summons or order, case particulars, a one-page chronology, the relevant bank or property trail, and the exact next deadline. Do not alter, rename or selectively delete electronic records.
